Terms of Service

These Terms of Service ("Terms") govern your access to and use of unblot (the "Service"), operated by Andrew James Finlayson (sole trader) trading as Unblot, ABN 87 528 719 524 ("unblot", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you are using unblot on behalf of a business, you confirm you are authorised to bind that business.

1. The Service

unblot connects to your Klaviyo account, analyses profile engagement, estimates potential savings from a lower Klaviyo billing tier, and — at your direction — suppresses unengaged profiles in Klaviyo. Savings figures are estimates based on Klaviyo's published pricing and your list data; they are not guarantees of any particular outcome.

2. Accounts & eligibility

You must provide accurate account information and keep your login secure. You are responsible for all activity under your account. You must be at least 18 and able to form a binding contract.

3. Subscriptions, billing & cancellation

  • Paid plans are billed in advance on a recurring basis through our payment processor, Stripe. By subscribing you authorise recurring charges until you cancel.
  • You can change or cancel your plan at any time from your account or the Stripe customer portal. Cancellation takes effect at the end of the current billing period; access continues until then.
  • Except where required by law (including the Australian Consumer Law), fees are non-refundable and partial periods are not pro-rated on downgrade beyond what Stripe applies automatically.
  • We may change pricing on reasonable notice before your next renewal.

4. Connecting Klaviyo & your authorisation

You connect Klaviyo via Klaviyo's official OAuth. By connecting, you authorise unblot to read profile and engagement data and, when you explicitly confirm a suppression, to suppress the selected profiles in your Klaviyo account on your behalf. You are responsible for ensuring you have the right to authorise this and for reviewing each suppression before confirming it. Suppression and unsuppression are subject to Klaviyo's own rules (for example, Klaviyo restricts re-suppressing a profile within 90 days of unsuppression).

5. Acceptable use

You agree not to:

  • use the Service unlawfully or in breach of Klaviyo's terms;
  • access the Service of others, or attempt to circumvent security or access controls;
  • interfere with, overload, or reverse-engineer the Service; or
  • use the Service to process data you are not authorised to process.

6. Your data & privacy

Our handling of personal information is described in our Privacy Policy. Where we process personal data of your contacts on your behalf, our Data Processing Agreement applies and forms part of these Terms.

7. Intellectual property

We retain all rights in the Service and its software. You retain all rights in your data. We may use aggregated, de-identified data to operate and improve the Service.

8. Third-party services

The Service relies on third parties including Klaviyo, Stripe, Clerk and Amazon Web Services. We are not responsible for those services, their availability, or their terms, which you are subject to separately.

9. Disclaimers

To the extent permitted by law, the Service is provided "as is" without warranties of any kind. We do not warrant that savings estimates will be achieved or that the Service will be uninterrupted or error-free. Nothing in these Terms excludes guarantees that cannot be excluded under the Australian Consumer Law; where we are permitted to limit liability for breach of such a guarantee, our liability is limited to resupplying the Service or paying the cost of resupply.

10. Limitation of liability

To the extent permitted by law, neither party is liable for indirect or consequential loss, and our total liability arising out of or in connection with the Service is limited to the fees you paid us in the 12 months before the event giving rise to the claim.

11. Indemnity

You agree to indemnify us against claims arising from your breach of these Terms, your misuse of the Service, or your lack of authority to process data you connect to the Service.

12. Term & termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or to comply with law. On termination, your right to use the Service ends; the sections intended to survive (including IP, disclaimers, liability and indemnity) continue.

13. Changes

We may update these Terms from time to time. If we make material changes, we will give reasonable notice (for example, by email or in-app). Continued use after changes take effect means you accept them.

14. Governing law

These Terms are governed by the laws of South Australia, Australia, and you submit to the non-exclusive jurisdiction of its courts.
